Attorney Lauren P. Raysor announced on Friday, June 23 in Mount Vernon, the lawsuit will be filed on behalf of Nicole Duncan, the mother of Mainece Simpson, a student at Mount Vernon High School and a member of the school’s cheerleading team who was stabbed numerous times by a rival cheerleader but survived.
Officials said that shortly before 4 p.m. on Friday, April 8, 2022, in Mount Vernon, a fight broke out during the high school’s celebratory parade between multiple girls that left two with stab wounds.
Mainece Simpson suffered non-life-threatening lacerations, while the other, later identified as 16-year-old Kayla Green, suffered a critical stab wound and died from her injuries en route to Jacobi Medical Center in the Bronx.
The 15-year-old defendant, who was not identified, pleaded guilty to the killing of the 16-year-old on Tuesday, Dec. 20, 2022, and was sentenced to three to nine years in prison.
Raysor claims that the school district, the local police, and the cheerleading coach knew of the danger that Mainece was in, but failed to intervene on her behalf.
Raysor says there was not enough security or police presence to prevent this incident from happening. The family says that the attacker should have been charged with murder instead of manslaughter for the attacks.
The city of Mount Vernon declined to comment on the pending lawsuit.
